Policy Terms

1. Acceptance of Terms These Terms of Use govern access to and use of www.jubacars.net, any Juba Cars Android or iOS app, and related marketplace tools and communication channels. By using the platform, you agree to these Terms and any additional marketplace rules, dealer onboarding rules, or service notices incorporated by reference.
2. Platform purpose Juba Cars is a vehicle marketplace built for East Africa. Its purpose is to connect buyers with verified dealers that have physical business locations. The platform does not permit private or individual sellers to list vehicles.
3. No dealership ownership transfer by platform Juba Cars provides marketplace and communication functionality. Unless expressly stated otherwise in writing, Juba Cars is not the owner of listed vehicles, is not the seller of vehicles, and is not automatically a party to the sale contract between buyer and dealer.
4. Eligibility and account responsibility Users must be of legal age and capable of entering binding arrangements. If you create an account, you are responsible for keeping credentials secure and for all activity under your account.
5. Buyer use of the platform Buyers may search listings, save vehicles, send inquiries, request callbacks, request appointments, and use other marketplace features made available from time to time. Buyers must provide truthful contact information and communicate respectfully and lawfully.
6. Dealer eligibility and verification Only approved dealers that satisfy Juba Cars’ onboarding and verification requirements may list vehicles. Juba Cars may request licenses, business information, physical location details, representative identity documents, tax information, ownership or authority records, and other materials reasonably required for trust, compliance, and marketplace quality.
7. Dealer responsibilities Dealers must ensure that listings are accurate, lawful, up to date, and not misleading. Dealers are responsible for their own stock, prices, warranties, mileage disclosures, condition statements, regulatory compliance, financing offers, taxes, and final sale paperwork. Dealers must promptly remove sold, unavailable, or materially inaccurate listings.
8. No private-seller listings Individuals and private sellers are prohibited from posting vehicle listings. Juba Cars may remove any listing, account, or content that appears to be connected to an unauthorized seller or misrepresented business.
9. Inquiries and communications By sending an inquiry or request through the platform, a buyer authorizes Juba Cars to forward the contact details and message to the relevant dealer and to use reasonable communication tools, including email, phone, SMS, WhatsApp, or app notifications, to facilitate a response.
10. Trust and safety Juba Cars may investigate suspected fraud, fake listings, abusive conduct, suspicious messaging, duplicate dealer profiles, bait-and-switch practices, manipulated photos, false dealership claims, and any other misuse or activity that may harm users or the platform.
11. Vehicle information and buyer diligence Although Juba Cars seeks to maintain a professional marketplace, listing information is supplied primarily by dealers. Buyers should independently inspect vehicles, verify ownership and availability, confirm pricing and terms, and perform any financing, roadworthiness, service-history, or legal-status checks they consider necessary before purchase.
12. Prohibited conduct Users may not post false information, scrape or systematically harvest data without permission, use the platform for spam or unlawful marketing, impersonate another person or business, interfere with platform security, or use the service in any unlawful or abusive way.
13. Paid features Juba Cars may offer dealer subscriptions, listing packages, premium placement, promotional products, inspection-related services, advertising, or other paid services. Pricing, duration, renewal, and inclusion details will be stated in the relevant offer, invoice, order page, or dealer agreement.
14. Suspension, removal, and termination Juba Cars may remove listings, suspend accounts, reject dealer applications, or terminate access where there is suspected fraud, failed verification, inaccurate information, non-payment, misuse, policy breach, legal risk, or conduct that could damage users or the platform.
15. Intellectual property Juba Cars and its licensors retain rights in the platform, software, databases, design, text, branding, and marketplace materials. Users retain rights in their own lawful content but grant Juba Cars a limited license to host, display, reproduce, and distribute submitted materials as needed to operate and promote the marketplace.
16. Privacy Personal data is handled in accordance with the Juba Cars Privacy Policy. By using the platform, users acknowledge that their inquiry details may be shared with relevant dealers and that dealers may process those details under their own lawful procedures.
17. Refunds and cancellations Refunds, where available, are governed by the applicable Refund & Cancellation Policy, dealer agreement, offer, or invoice. Promotional products, listing boosts, already-delivered advertising placements, and consumed services may be non-refundable.
18. Disclaimers To the maximum extent permitted by law, the platform is provided on an “as is” and “as available” basis. Juba Cars does not guarantee that every listing is error-free, that every dealer will complete a transaction, or that every vehicle will remain available, unless Juba Cars expressly undertakes such obligation in writing.
19. Limitation of liability To the maximum extent permitted by law, Juba Cars is not liable for indirect, incidental, special, punitive, or consequential losses, including lost profits, missed opportunities, travel costs, or losses arising from dealer conduct or buyer decisions. Juba Cars’ aggregate liability arising out of the platform shall not exceed the amount paid to Juba Cars by the claimant for the specific paid service giving rise to the claim during the [12]-month period before the event, unless law requires otherwise.
20. Indemnity Users agree to indemnify and hold harmless Juba Cars, its affiliates, staff, and service providers against claims, liabilities, losses, and costs arising from their content, listings, breach of these Terms, unlawful acts, or violation of third-party rights.
21. Changes to platform or Terms Juba Cars may update marketplace features, onboarding standards, pricing, and these Terms from time to time. Material changes may be announced on the platform, by email, or through app notices.
22. Governing law and disputes These Terms are governed by the laws of the United Republic of Tanzania unless another mandatory law applies. The parties shall first attempt to resolve disputes in good faith. Unresolved disputes may be referred to the competent courts or another lawful dispute-resolution process specified in a separate agreement.
